Agreement
By accessing or using BrushUp (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. We may update these terms; the "Last updated" date will change and continued use after changes constitutes acceptance where the law allows.
The Service
BrushUp provides educational tools and content related to dental nursing and related topics. Features may change, be suspended, or be discontinued. We aim for reliable availability but do not guarantee uninterrupted access.
Not professional or clinical advice
Content is for learning and exam preparation only. It is not medical, dental, legal, or professional advice and does not replace training, supervision, workplace policies, or clinical judgement. Always follow your employer, regulator, and local laws. You are responsible for how you apply any information.
Accounts and eligibility
You must provide accurate registration information and keep your account secure. You are responsible for activity under your account. You must meet any minimum age or eligibility requirements stated when you sign up. Notify us promptly of unauthorised use.
Acceptable use
You agree not to misuse the Service: no unlawful activity; no attempting to gain unauthorised access; no interfering with or overloading systems; no scraping or automated access except as we expressly permit; no sharing of content in a way that infringes others' rights; and no harassment or harmful conduct. We may suspend or terminate access for violations.
Intellectual property
The Service, including text, graphics, logos, software, and other materials, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable licence to use the Service for your own learning in line with these terms. You may not copy, sell, or redistribute our materials except as allowed by law or with our written permission.
User content
If you submit content to the Service, you represent you have the right to do so. You grant us a licence to host, use, and display that content as needed to operate and improve the Service, subject to our Privacy Policy.
Third-party services
The Service may integrate authentication, hosting, or other third-party services. Their terms and privacy practices may also apply. We are not responsible for third-party services we do not control.
Fees
Some features may be free and others paid or subscription-based as described in the app. If you purchase a paid plan, payment terms shown at checkout apply. Unless required by law, fees are generally non-refundable except as stated at purchase.
AI fair use and lifetime access
All Pro accounts, including lifetime and complimentary accounts, share 30 AI requests per UTC day and 300 per calendar UTC month across Tutor and SAM. Unused requests do not roll over. A request accepted for AI processing counts once, including provider failure. One reply can be in progress per account and a five-second cooldown applies. Automated use, account sharing, bulk generation and resale are outside fair use. Existing lessons and question practice do not consume this allowance. Any changed allowance will be explained in the app with its effective date before it applies. Lifetime means ongoing Pro app and content access while BrushUp operates; it does not mean unlimited AI or a fixed provider forever.
Disclaimers
The Service is provided "as is" and "as available" to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising from course of dealing or usage.
Limitation of liability
To the fullest extent permitted by law, we and our suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service is limited to the greater of amounts you paid us in the twelve months before the claim or fifty pounds sterling (GBP 50), except where liability cannot be limited by law (including death or personal injury caused by negligence where applicable).
Indemnity
You agree to indemnify and hold harmless BrushUp and its team from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, violation of these terms, or violation of others' rights, to the extent permitted by law.
Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these terms, risk to the Service or users, or legal reasons. Provisions that by their nature should survive will survive termination.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence where those laws cannot be contracted away.
